II.2)QUANTITY OR SCOPE OF THE CONTRACT
II.2.1)Total quantity or scopeArts Council of Wales is seeking tenders for the provision of the development of professional dance product in Wales. We wish to appoint either a single person, organisation or a consortium. The task will be to manage the producing of new dance and to support artists and companies to develop their capability in whatever areas are appropriate to their stage of development.

III.1)CONDITIONS RELATING TO THE CONTRACT
III.1.1)Deposits and guarantees requiredEach tenderer will provide an accurate estimate of whatever services or support of the proposal may be guaranteed in kind or via direct support of collaborators in the proposal.
III.1.2)Main financing conditions and payment arrangements and/or reference to the relevant provisions regulating themEach tenderer shall be deemed to have satisfied themselves before submitting a proposal as to the accuracy of the financial information in their proposal, which shall (unless otherwise provided) cover all obligations under the contract. Each tenderer will also be deemed to have obtained for themselves all necessary information as to risks, contingencies, and any other circumstances, which might reasonably affect their submission. Any third parties or collaborators in the bid must provide proof of their bona fide status and that they are legal and constituted entities if they are to be involved in any routing of monies involved in the activity of the creative producer. We will need to be assured appropriately accountable safeguards are in place for the use of public funds.
III.1.3)Legal form to be taken by the group of economic operators to whom the contract is to be awardedWhere the Tenderer is a consortium, the lead consortium member must remain the same as when originally shortlisted. The full consortium membership must be disclosed and set at the time of submission of the Invitation to tender response and there must be no material changes in the consortium after the tender submission. Arts Council of Wales must be advised of any change in the consortium membership or in the principal relationships between members of the consortium. Any change which is considered material will lead to the Tenderer's disqualification.
III.1.4)Other particular conditions to which the performance of the contract is subjectYes
That an agreed programme will be for 36 months from the agreed start date of the contract. The successful tenderer will be required to coordinate all aspects of the services set out in the invitation to tender document. This should include providing a timetable of activities and a financial plan with milestones for the duration of the period with an Exit Strategy which considers the future role of the creative producer within the wider context of the arts in Wales.

(g) is guilty of serious misrepresentation in supplying the information required under the provisions of the Directive on the criteria for qualitative selection;
