Object of the Contract:
The Merlin Helicopter is currently undergoing a major upgrade to introduce a new mission system. The contract for this programme was awarded to Lockheed Martin (UK) in 2005 for the delivery of Merlin Mk2 helicopters through modification to the existing Merlin Mk1 fleet. Part of the contracted scope is the introduction of a fully integrated camera system and a defensive aids suite into the existing complex mission system design but installed on a very limited proportion of the fleet. The object of this contract amendment is to increase the number of aircraft equipped with defensive aids, to be completed concurrently with the existing upgrade, and to include the systems in the aircraft training simulators.
Justification for non competitive decision.
It is considered that this contract can be placed using the Negotiated Procedure Without Prior Publication of a Contract Notice pursuant to Regulation 16(1)(a)(ii) and 16(1)(b)(i) of the UK Defence and Security Public Contracts Regulations 2011 and Article 28(3)(a) and 28(1)(e) of Directive 2009/81/EC for technical reasons. The use of another economic operator to integrate and maintain the defensive aids equipment in the existing Merlin Mk2 Helicopter design would:
- Result in a disproportionate technical difficulty due to the complexity and level of integration with the current Mission System software and hardware design.
- Oblige the contracting authority to acquire a solution having different technical characteristics to the design currently being delivered by Lockheed Martin, resulting in incompatibility between the existing installation and the one purchased under this contract. The effective operation and maintenance of the defensive aids system would be adversely affected to a level that places excessive capability risks on the UK Ministry of Defence.
With reference to DSPCR Regulation 16(3), the term of the contract is less than 5 years.
