""The Secretary of State for Defence (the Authority) through the Air Commodities Project Team intends to amend Contract No: ASCOMM4/541 for the Supply of Mobile Adjustable (Crew/Maintenance) Access Steps (MAAS), relevant post design services with T B Davies (UK) Ltd ("the Contractor”) to include the modification and motorised upgrade of the manually operated hydraulic pump to meet recent amended Health and Safety requirements and subsequent consequential ongoing repair and maintenance requirements.
It is considered that this contract amendment can be placed with the Contractor using the Negotiated Procedure without Prior Publication of a Contract Notice pursuant to Article 31(1)(b) of Directive 2004/18 EC (Regulation 14(1)(a)(iii) of the Public Contracts Regulations 2006). This is for technical reasons and reasons connected with the protection of exclusive rights. In relation to exclusive rights, this in the form of copyright, confidential information and other exclusive rights in the design, drawings, and other technical data relating to MAAS which reside exclusively with the Contractor and are considered necessary for the performance of the proposed additional contract services.
The proposed additional contract services cannot be provided without access to that proprietary information and data. In addition, it is considered that as the certifying authority for MAAS only the Contractor can carry out and certify the required modifications and subsequent maintenance services to the satisfaction of the Authority and which the Authority can reasonably rely on both from an interoperability and safety perspective.”
