It is considered that this contract can be placed using the negotiated procedure without prior publication pursuant to Directive 2009/81/EC Article 28 (3) (a) (Regulation 16 (1) (a) (ii) of the UK Defence and Security Public Contracts Regulations 2011) on the basis of exclusive rights and for technical reasons. This is because BAE Systems is the UK Prime Contractor for the equipment, shares exclusive rights for this equipment with its major subcontractor and the in-service support services can not be provided without access to those exclusive rights and for technical reasons only BAE Systems has the expertise, know-how and tools to provide the in-service support services.
