II.1.5)Short description of the contract or purchase(s)
There is recognition of the positive impact and benefits that mobile phone coverage can have on societies and local economies. There are areas in the United Kingdom, particularly remote areas, where there is no or inadequate mobile coverage called ‘Not Spots’ which lead to a poor or limited customer experience. The Mobile Infrastructure Project (MIP) anticipates that consumers and businesses will benefit from improved coverage from 2013 onwards. The aim of the MIP is to establish a single supplier framework agreement capable of delivering improved mobile coverage in ‘Not Spots’ through the delivery of new, or use of existing, mobile network infrastructure. There is recognition that this infrastructure may need to allow future delivery of data services.
The supplier appointed to the framework agreement will need to be capable of delivering a range of telecommunications infrastructure solutions and related requirements, including (but not limited to) the design, build, implementation and operation of telecommunications infrastructure in accordance with BDUK’s requirements (which will reflect the requirements of the mobile network operators).
It is currently anticipated that the term of the framework agreement will be four years. Call off contracts will operate for a minimum term that will take into account State aid and other relevant requirements.
The estimated aggregated total value of payments from DCMS under the potential call off contracts is between 50 000 000 and 200 000 000 GBP (see further details on financing arrangements in Sections II.2.1 and III.1.2).

There is the potential for call off contracts under the framework agreement to amount to an estimated total value of payments from DCMS of between 50 000 000 and 200 000 000 GBP. This estimated total value is based on the total level of public subsidy that is available towards the funding of projects. The public subsidy will comprise BDUK funding and possibly other third party funding which may include Local Authorities and/or Devolved Administrations. See further details on financing arrangements in Section III.1.2. Separate private sector investment will comprise investment from mobile network operators who will pay for the operational costs of the infrastructure.

The infrastructure projects called off under the framework will be funded by public subsidy. The level of anticipated public subsidy will involve the granting of State aid. Further detail on the relevant aspects of the financing and payment approach will be provided in the Invitation to Tender documents to be issued to pre-qualified bidders.

Requests to participate may be submitted by a single candidate or a group (consortium). Where a candidate is a group (consortium), each member of the group (consortium) may be required to contract on the basis of joint and/or several liability, or a single member may be required to contract on a prime contractor basis or the members of the group may be required to form or incorporate a special purpose vehicle at the discretion of DCMS. Section II.1.9 - DCMS will confirm whether variant bids are accepted in the Invitation to Tender. If so, the terms and conditions for variant bids will be outlined in the ITT documentation.
DCMS shall not be responsible for any costs, charges or expenses incurred by candidates or tenderers and accept no liability for any costs, charges or expenses, irrespective of the outcome of the competition, or if the competition is cancelled or postponed. The Mobile Infrastructure Project Industry Day will take place on 8.5.2012 in central London.
The Industry Day is aimed at prime contractors, consortia, sub-contractors or other interested parties in the Mobile Infrastructure Project supply chain who may be interested in responding to this framework opportunity to give an overview of the MIP programme and the procurement.

Organisations wishing to attend the Industry Day must register their attendance in advance. Attendance will be limited to four representatives per organisation (preferably with commercial and/or technical expertise), and expressions of interest will be dealt with on a first come, first served basis. Expressions of interest in attending the Industry Day should be emailed to by 12:00 on 4.5.2011. VI.4.2)Lodging of appeals
Precise information on deadline(s) for lodging appeals: In accordance with Regulation 32 of the Public Contracts Regulations 2006 (as amended) DCMS will incorporate a minimum 10 calendar day standstill period at the point information on the framework agreement award decision is communicated to tenderers. Part 9 of the Public Contracts Regulations 2006 (as amended) provides for economic operators who have been harmed or are at risk of harm by breach of the Regulations to take legal action. Any such action must be brought within the applicable limitation period. The purpose of the standstill period referred to above is to allow an economic operator to apply to the Court to set aside the award decision before the framework agreement is entered into.
