Justification for the choice of the negotiated procedure without prior publication of a contract notice in the OJEU in accordance with Directive 2004/18/EC
The works/goods/services can be provided only by a particular tenderer for reasons that are: technical, connected with the protection of exclusive rights
The Council believes that the negotiated procedure without prior publication of a contract notice is available pursuant to Regulation 14(1)(a) (iii) of the Public Contracts Regulations 2006, on the basis that the redevelopment can only be carried out by Silex for technical reasons, as well as reasons connected with the protection of Silex's property rights over a significant and strategic portion of the land concerned by the redevelopment. Silex has also entered into exclusive purchase option contracts with the other private land owners of the relevant site. Whilst the Council could compulsorily acquire other landowners Silex would only carry out a scheme where its land interests were incorporated on commercial terms which it had agreed.
