Although the Contracting Entity does not regard itself bound by Directive 2004/17 or the Utilities Contract Regulations 2006, it has decided to place this advertisement in the OJEU on a voluntary basis. While the Contracting Entity is basing this tender process on the negotiated procedure provided for in the Regulations it does not regard itself as bound by that procedure and may depart from the procedure as provided for in the Regulations at any time.
The publication of the PQQ is a reflection of the commitment to the principles of the project although bidders should note that Gatwick Airport Limited is in the process of following its own internal governance process to seek funding. In the interests of expediency GAL will pre-qualify bidders and proceed to the invitation to tender (ITT) stage if and when budget is approved. Gatwick Airport Limited reserves the right to cancel the procurement process at any stage and not proceed with the award of contract.
