II.1.5)Short description of the contract or purchase(s)
The Group wishes to award Collabrative Framework Agreement for NonHalf Hourly Electricity and Natural gas.
The Framework Agreement shall be established for a period of 2 years with an option to extend for a further period of no more than 2 years.
The Framerork is separated into 2 separate lots:
- lot 1 Non Half Hourly Electricity
- lot2 Natural Gas
Suppliers may bid for lot 1 or lot 2, or all lots.
Provision for supply and installation of Automatic Meter Reading and SMART metering by awarded framework suppliers over the course of the framework. Optional Provision of various generation mixes such as renewable energy will be considered.
The Framework Agreement will be initially for the use of Fabrick Housing Group, it is also proposed to widen the number of organisations in the future who would be able to take up this opportunity by making the Collaborative Framework Agreement available for use by other UK contracting authorities (as defined in Article 1(9) of Directive 2004/18/EC and implemented by Regulation 3 of The Public Contracts Regulations 2006) or its agent(s).
These include but are not limited to central government departments and their agencies. Non-Departmental Public Bodies (NDPBs), NHS bodies (including: acute trusts, ambulance trusts, primary care trusts, care trusts, NHS hospital trusts, strategic health trusts, special health authorities), Local Authorities (as defined in Regulation 3(2) to (5) of the Public Contracts Regulation 2006 ('the Regulations'), Police Crime Commission
The framework will also be open for use by all other public sector contracting authorities (as defined in Article 1 (9) of Directive 2004/18/EC and implemented by Regulation 3 of the Public Contract Regulations 2006) or their agents. These include but are not limited to central government departments and their agencies, Non-Departmental Public Bodies (NDPBs), NHS bodies (including; acute trusts, ambulance trusts, primary care trusts, care trusts, NHS hospital trusts, strategic health authorities, mental health trusts, special health authorities), Local Authorities (as defined in Regulation3 (2) to (5) of the Public Contracts Regulations 2006 ('the Regulations'), Police Authorities (as defined by Regulation 3 (1) (j) to (p) of the Regulations), Emergency Services, Educational

Contracts between awarded framework suppliers and individual framework end users will be developed by subsequent further competitions from the framework. Individual framework end users will be required to provide a minimum of 12 months notice to terminate a contract prior to the next contract expiry date.
The agreement will be managed on behalf of those using the framework agreement by the Utilities procurement Group Ltd. Due to the constant fluctuation of commodity market rates the pricing element of this framework will be reviewed by UPG Ltd on a ongoing basis in relation top commodity based markets, at the further competition stage it is anticipated that framework suppliers will offer their best rate in accordance with the aggregated demand delivered through the framework. Further and more detailed information will be contained in the Invitation to tender documentation. The framework is open only to 2nd tier licensed suppliers.

Lot 2 Supply of Natuural Gas GBP 200 000 to GBP 35 000 000. It is anticipated that the volume requirement will not exceed 300GWH over the course of the agreement.

VI.4.2)Lodging of appeals
Precise information on deadline(s) for lodging appeals: UPG will incorporate a minimum 10 day standstill period at the point that information on the award of the contract is communicated to tenderers. This period will allow unsuccessful tenderers to seek further debriefing from the contracting Authority before the contract is entered into. Applicants have 2 working days from the notification of the award decision to request additional debriefing and that information has to be provided a minimum of 3 working days before the expiy of the standstill period. Should such additional information be required, please contact the person cited in paragraph 1.1 of this form. If an appeal regarding the award of a contract has not been successfully resolved the Public Contracts Regulations (SI 2006 no 5) provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the high court (england, Wales and Northern Ireland). Any such action must be brought promptly (within 3 months from the time the aggrieved party knew, or ought to have known, about the alleged breach).
Where a contract has not been entered into the court may order the setting aside of the award decsion, or order the Contracting Authority to amend any document and may award damages. If the contract has been entered into the court may order the setting aside of the contract, may award damages and impose a financial penalty on the Contracting Authority. Damages may also be available to any of the parties involved. The purpose of the standstill period referred to above is to allow parties the opportunity to challenge the award decisionmade by the Contracting Authority and, where appropriate, issue proceedings against the Contracting Authority which shall have the effect of automatically suspending the contract award procedure until the proceedings have been concluded.
