The EU Emissions Trading System (EU ETS) is at the heart of UK Government policy to tackle climate change. The Auctioning Regulation sets out the administrative details of auctioning emissions allowances under the EU ETS. More detail on the Auctioning Regulation is available on the European Commission website at: http://ec.europa.eu/clima/policies/ets/auctioning/third/index_en.htm

Under the Auctioning Regulation the UK opted to set up a definitive national auction platform to auction its share of allowances. This contract relates to the appointment, set up and running of the UK's definitive auction platform for phase III and aviation EU emission allowances. The contract was awarded by the Department of Energy and Climate Change (DECC) as Contracting Authority on 19.11.2012.

Precise information on deadline(s) for lodging appeals: Under the provisions of Article 30 of the Auctioning Regulation the proposal for a UK auction platform must be approved by the European Commission and the EU Climate Change Committee. The contract cannot enter into force until the platform has been listed in Annex III to the Auctioning Regulation. The Authority will as soon as possible after the decision has been reached inform tenderers and candidates of its decision to award the contract and provide the information required by Regulation 32 of the Public Contracts Regulations 2006. It will observe the standstill period required by regulation 32A of those Regulations. Following this period, the contract will be awarded subject to the listing of the successful platform in Annex III to the Auctioning Regulation. Between contract award and listing of the UK auction platform the Contractor will be expected to work closely with the Contracting Authority in its engagement with the European Commission and work towards putting in place the necessary arrangements that will ensure the timely commencement of auctioning.
The Regulations provide that where a duty owed to economic operators is not observed by the Contracting Authority the breach is actionable in the High Court (England, Wales and Northern Ireland). Any such action must be brought promptly (generally within 3 months).
