Norfolk County Council wishes to offer opportunities to provide catering in 14 Housing with Care Establishments in Norfolk. (Norwich x3, Cromer, Aylsham, Downham Market, Great Yarmouth, Kings Lynn, Diss, Gorleston, Thetford, Kelling and Wymondham). The supplier(s) will prepare and provide meals and refreshments for Housing with Care tenants, Care employees, Family, Friends and any other visitors.
The Restaurant will operate 7 days per week providing lunch time meals and offering choices of meals with a minimum of 2 main course and dessert options. Special dietary requirements will be met on an individual basis as required. The Restaurant will also provide a range of snack items (such as jacket potatoes with fillings, assorted sandwiches, cakes, etc.) as well as a selection of beverages. The Restaurant income could be further supplemented by opportunities to provide breakfasts, evening meals as well as providing catering services for in-house and external events.
The tender will be for a Local Authority Concession Agreement (the Council is to allow suppliers to carry out a service from which they (the suppliers) derive income directly from clients without any subsidy from the Council).

There are 14 lots covering Norfolk which will be awarded independently of each other. The initial term is 48 months with the option to extend for a further 48 months. The contract value is dependent on the number of meals supplied by the concessionaire to tenants of the extra care complex on an annual basis. Revenue, demand and cost risks will be with the concessionaire.

The contract is a services concession contract and therefore falls outside the scope of the application of the Directive. The Council, in consideration of the estimated value, size and nature of the concession, and the geographic location of the place of performance of the contract, considers that this concession does not give rise to any obligations derived from the EU Treaty, including any obligation to advertise.
The contract value given at Section is the Council's estimate of the value of the meals supplied by the concessionaire to residents of the extra care complex on an annual basis. Revenue, demand and cost risks however all remain with the concessionaire.
